Terms of Use

1. Acceptance of Terms

By creating an account or using Jump'N, you confirm that you can form a binding contract with Olu Designs and that you will comply with these Terms and all applicable local, state, and international laws.

2. Jump'N Services and Our Role

Jump'N is a platform that allows users ("Organizers") to create, list, and promote events, and allows other users ("Consumers") to browse and interact with those events.

• Platform Only: Jump'N is not the creator, organizer, or owner of any events listed on the Services. We are a platform provider.
• Responsibility: The Organizer is solely responsible for the events they list, including ensuring the event is safe, legal, and conducted as described.

3. Your Account

To use certain features, you must register for an account.

• Accuracy: You agree to provide accurate, current, and complete information.
• Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
• Termination: We reserve the right to suspend or terminate your account at any time, for any reason, including for violations of these Terms.

4. Your Content and Trademarks

You may post content, including text, photos, and logos ("Your Content").

• Ownership: You retain ownership of Your Content.
• License to Jump'N: By posting Your Content, you grant Olu Designs a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, and display Your Content in connection with providing and promoting the Services.
• Representations: You represent that you have all necessary rights to grant this license and that Your Content does not infringe on any third-party rights.

5. Prohibited Conduct

You agree not to:

• Use Jump'N for any illegal purpose or in violation of any local, state, or federal law.
• Post content that is hateful, threatening, pornographic, or incites violence.
• Interfere with the security or operation of the Services.
• Scrape or use automated systems to extract data from the platform without our express permission.

6. User-Generated Content and Objectionable Content

Jump'N lets users post comments, ratings, photos, videos, threaded replies, and live streams ("User-Generated Content"). There is no tolerance for objectionable content or abusive users. By using the Services you agree that:

• No objectionable content: You will not post content that is defamatory, discriminatory, hateful, harassing, threatening, sexually explicit, pornographic, or violent, that contains nudity or offensive gestures, that promotes illegal activity, or that misrepresents another person's name, image, or likeness.
• No abusive behavior: You will not bully, harass, intimidate, impersonate, spam, or target other users.
• Reporting: Every post, reply, and live stream has a "•••" menu with a "Report content" option. Reported content is immediately hidden from public feeds while our moderation team reviews it.
• Blocking: The same menu includes "Block user". Blocking instantly removes that user's content from your view and notifies our moderation team.
• Moderation: We review reports within 24 hours, remove objectionable content, and suspend or permanently ban users who post it. Confirmed violations result in strikes; three strikes results in a permanent ban.
• Filtering: We use automated filters that may hold content for review before it appears publicly.
• Your responsibility: You are solely responsible for the content you post. We may remove any content and terminate any account that violates these Terms, at any time and without notice.

7. Fees and Payments

If you purchase tickets or services through Jump'N, you agree to pay all applicable fees.

• Refunds: Refund policies are set by the Organizers. Jump'N is not responsible for issuing refunds unless otherwise stated in a specific Merchant Agreement.
• Taxes: Organizers are responsible for determining and collecting any taxes applicable to their events.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. OLU DESIGNS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLU DESIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Olu Designs and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Services, Your Content, or your breach of these Terms.

11. Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

• Arbitration: Any dispute arising out of or relating to these Terms will be settled by binding arbitration in the state of Pennsylvania.
• Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Modifications to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of Jump'N after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Pennsylvania, without regard to its conflict of laws principles.
